Policing Act 1987. It widens the power to make regulations under section three alpha one so that provision can be made that relates to the governance administration of Ministry of Defense Police or MDP for short. This will give the sector state a power that is similar to the power of the sector state as under section 51 of the Police Act 1996 to make regulations for members of the Territorial Police Forces in England and Wales. It will also enable regulation to make provisions so that a member of the MDP can be suspended from the office of the constable if they suspended are from duty. As a consequence of amendment to section three a, it makes a minor amendment to section four one so that the requirement to make regulations and make provision relating to representation at disciplinary proceedings is aligned with the power in section eighty four one of the Police Act 1996.
Also makes a minor amendment to the power in section four a to make provision for police appeal tribunals to remove a reference to legislation schedule three, the Police and Fire Reform Scotland Act 2012 that was recently revoked by the Scottish government. I now move to clause 43. Cross border powers of arrest are set out in part 10 of the Criminal Justice and Public Order Act 1994. Our offenses are committed in one legal jurisdiction in The UK. Cross border powers of arrest enable police officers to arrest suspects in other legal jurisdictions in The UK.
The purpose of the amendment made by clause 43 is to make clear the powers in part 10 can be exercised by members of the NDP within the jurisdiction set out in section two of the Ministry of Defense Police Act 1987. The amendment will also slightly enlarge jurisdiction to act for nondevent purposes to execute arrest warrants at the request of other police forces and to arrest suspects where it is not possible to wait for the arrival of a member of the local force. Similar amendments have already been made for members of the British Transport Police and Civil Nuclear Constabulary. Moving on to clause 44. This clause amends section two of the Police Property Act 1987 to enable the sector of state to make regulations allowing unclaimed property in the possessions of the MDP to be retained so it can be used for police purposes.
