Parliamentary Joint Committee on Intelligence and Security

2 August 2026

Parliamentary Joint Committee on Intelligence and Security Australian Parliament

10:08 - 11:28
Speaker 3
Excellent.  All right.  Okay.  Well, good morning, everyone.  I'd like to now declare open this public hearing of the Parliamentary Joint Committee on Intelligence and Security for its review of the Australian Criminal Intelligence Commission Reform Package 2024.

I want to begin by acknowledging the traditional custodians of the land on which we're all meeting today and pay my respects to their elders past, present, and emerging.  Now, these are public proceedings, and although the committee may agree to requests to have evidence heard in camera or may determine that certain evidence should be heard in camera, I want to remind all witnesses that in giving evidence to the committee, they are protected by parliamentary privilege unless they are giving evidence outside of Australia.  Now, it is unlawful for anyone to threaten or disadvantage a witness on account of evidence given to a committee, and such action may be treated by the parliament as a contempt.  It's also a contempt to give false or misleading evidence to a committee.  Now, both houses of the Australian Parliament have resolved that an officer of a department of the Commonwealth shall not be asked to give opinions on matters of policy and shall be given reasonable opportunity to refer questions asked to a superior officer or to a minister.

Speaker 5
This prohibits only questions asking for opinions on matters of policy and does not preclude questions asking for explanations of policy or factual questions about when and how policies were adopted.  As the chair, I will ensure the proceedings are conducted in an orderly, respectful and courteous way, and I do remind members of the committee of their obligations under the behavior code for Australian parliamentarians and resolutions of both houses to treat witnesses with dignity, courtesy, fairness and respect.  In accordance with the committee's resolutions of the 26th of August 2025, this hearing will be broadcast on Parliament's website and the proof and official transcripts of proceedings will be published also on the Parliament's website.  The hearing today is being conducted with members of the committee and witnesses appearing by video conference.  Members and witnesses participating remotely are reminded to mute your microphones when not speaking.

Now, on that note, I want to welcome representatives of the Law Council of Australia to give evidence at this public hearing today.  Good morning.  For the Hansard record, could I ask that you please state your full name, the capacity in which you appear before today's hearing.
