Parliamentary Joint Committee on Corporations and Financial Services Australian Parliament

13:50 - 15:46
Speaker 6
Thank you very much.  I declare open this hearing of the Parliamentary Joint Committee on Corporations and Financial Services into the oversight of ASIC, the Takeovers Panel and the corporations legislation.  I begin today by acknowledging the Ngunnawal and Ngambri people, the traditional custodians of the land on which we meet.  And I pay my respects to their elders past and present.  I extend that respect to Aboriginal and Torres Strait Islander peoples here today.

The committee will be conducting today's hearing in person and via video conference.  These are public proceedings being streamed live via the Parliament's website and a Hansard transcript is being made.  However, witnesses also have a right to request to be heard in camera and the committee will consider any such requests.  I remind all witnesses that the giving of false or misleading evidence may be treated by the Senate as a contempt.  The committee also reminds all parties to this matter of the committee's commitment to the Parliament's procedures for the protection of witnesses.

The committee emphasizes that witnesses are protected by parliamentary privilege, making it unlawful for anyone to threaten or disadvantage a witness on account of evidence given to a committee.  Any such action taken against a witness may be treated by the Parliament as a contempt.  And the committee will ensure that any such action is vigorously investigated and, if necessary, referred to the Senate as a potential contempt.  If a witness objects to answering questions, they should state the ground upon which the objection is made and the committee will determine whether it will insist on an answer having regard to the ground which is claimed.  If the committee determines to insist on an answer, a witness may request the answer be given in camera.

I remind any committee members and witnesses who are appearing via teleconference to mute their microphones when they are not speaking.  And I just have had an indication that the media are attending.  If there are no objections, we'll accept that they are welcome here today to cover proceedings.
