Health Bill

25 June 2026

Health Bill House of Commons

00:02 - 00:36
Speaker 2
We are now sitting in public and the proceedings are being broadcast.  Before we begin, I'd like to remind members to switch all electronic devices to silent.  Tea and coffee are not allowed during sittings.  And also members will have noticed I've taken my jacket off, so please feel free to take yours off.  It's very hot in here today.

We now come to group 10 and amendment 57 to clause 12, with which it will be convenient to consider clause 12 stand part and clause 13 stand part.  I call Dr. Caroline Johnson to move amendment 57.

Speaker 1
Thank you, Chair.  I rise to move amendment 57 and also to discuss clauses 12 and 13 as you advise.  So clause 12 essentially, Chair, is conferring the commissioning duties of NHS England onto the Secretary of State because the NHS England is being abolished.  So in that respect, it's quite straightforward.  And in the existing act, NHS Act 2006, section 3 sets out the duties of integrated care boards to commission certain health services.

3A is similar.  And section 4 is NHS England's responsibility for the provision of high-security psychiatric services.  So what does clause 12 do?  Essentially, it replaces the references to NHS England in sections 3 and 3A with the Secretary of State.  And the ICBs now must act consistently with discharge by the Secretary of State of the section 1 duty to promote comprehensive health service.
